TICKETED FOR FAILURE TO KEEP RIGHT?
YOU WILL GET 2 POINTS ON YOUR LICENSE. WE CAN HELP
A Summons for Failure to Keep Right (39:4-83 or sometimes charged as 39:4-88) will cost you two
points on your license and as described below possible other penalties. This ticket is commonly
given to Truck Drivers who are not allowed to drive in the left hand lane on any highway or road with 2 or
more lanes. However, sometimes it is given to anyone who stays in the left lane other than to pass a car.
You are only allowed to be in the left hand lane of any roadway with two or more lanes to pass another car,
it is not considered a driving lane. In addition, to the points associated with this ticket you could also
receive up to 15 days in jail. (note that unless your offense involves an accident or other violations at the
same time, or a mandatory court appearance it is rare, but possible for a judge to impose jail or suspend
your license).
The Points associated with this ticket can cost you dearly on your insurance. For Insurance purposes it
takes 3 years from the date of your violation/conviction for the points to be eliminated off your insurance.
That is why a conviction for this offense should be fought with proper legal representation.
In addition to possible jail the judge does have the discretion to suspend your license. If you lose your
license either because you have accumulated too many points or because the judge feels that your
violation warrants a suspension, you could lose your job, your house and all that is important to you! Don't
