The penalties for possession of cocaine in the State of New Jersey vary
depending on the nature of the possession (i.e. simple possession or
possession with intent to distribute) and the weight of the drugs involved.  
The General Penalties are listed below:

1st Degree Offense:

If the quantity is greater than 5 oz. it is a 1st degree criminal offense punishable by up to
20 years in state prison with parole ineligibility for one-third to one-half of the sentence,
and a fine of up to $500,000.00

2nd Degree Offense:

If the quantity is more than 1/2 oz. but less then 5 oz. punishable by 7 to 10 years in state
prison and a fine of up to $75,000.00.

3rd Degree Offense:

If the quantity is a dusting but not more than than 1/2 oz. it is a 3rd degree criminal
offense punishable by 3 to 5 years in state prison and up to a $35,000.00 fine.


Additional Penalties Apply to all the above cases including loss of drivers license, probation
and drug screenings.  Furthermore If you are charged with possession of cocaine or crack
cocaine in a school zone, public housing project, or public park, see N.J.S.A. 2C:35-10 allows
the court to impose a community service requirement in addition to other penalties of at least
100 additional hours.
